How California reviews vanity plate requests

California reviewers assess every personalized request against published criteria, and they check meanings in Spanish as well as English because both are widely spoken in the state. Reviewers also test configurations read backwards and in a mirror to catch hidden meanings. Analysis of the DMV's own 2023 rejection data found that close to nine in ten refusals were because the configuration resembled a plate that already existed, not because anyone judged it offensive.

Common reasons for rejection

The explanation letter is the main route. Context genuinely matters here: the DMV will allow BOX for the owner of a box-shaped vehicle such as a Scion or a Porsche Boxster, and will allow 69 on a vehicle built in 1969, where both would otherwise be refused.

Approved

• • QUEER: approved after a federal court ruled California's offensiveness standard unconstitutional, in a case brought by a record label owner who had been refused
• • SPAAAZ: approved, while the very similar RSPAZ was refused, an inconsistency cited in court as evidence the standard was applied arbitrarily

Rejected

• • OGWOOLF: refused because reviewers read OG as a gang reference, despite the applicant being an Army veteran using a family nickname. The refusal was later challenged successfully
• • SLAAYRR: refused as threatening, though the applicant was a fan of the band Slayer

In Ogilvie v. Gordon, decided in the Northern District of California in November 2020, Judge Jon Tigar struck down the requirement that the DMV refuse configurations carrying connotations offensive to good taste and decency, holding it amounted to viewpoint discrimination under the First Amendment. The court drew on the Supreme Court's trademark decisions in Matal v. Tam and Iancu v. Brunetti.

Southern California has one of the highest concentrations of personalized plates in the country, which is part of why California configurations get taken so quickly. If your first choice is refused as already issued, that is usually competition rather than judgment.
